General Terms and Conditions

1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed via our online shop by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A business is a natural or legal person, or a partnership with legal capacity, acting in the exercise of its commercial or independent professional activity when entering into a legal transaction.

For businesses, the following applies: If the business uses conflicting or supplementary general terms and conditions, their validity is hereby rejected. They shall only become part of the contract if we have expressly agreed to them.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Ackermann Hohmann & Sedlacek OHG.

The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding online catalogue. You may initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. By clicking the order button, you submit a binding offer to purchase the products contained in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after your order has been submitted.

We accept your offer within two days by:

  • sending a separate email confirming acceptance; or
  • where applicable, processing the payment transaction through our payment service provider or the selected payment service provider. The time at which the payment transaction is processed depends on the selected payment method (see "Payment").

The relevant alternative is whichever of these events occurs first.

3. Contract Language and Storage of the Contract Text

The language(s) available for concluding the contract are: German and English.

We store the contract text and send you the order details together with these General Terms and Conditions in text form. You can also view the contract text in your customer account.

4. Subject Matter of the Contract

4.1 Product Description

The respective product description shall be deemed an integral part of the contract.

4.2 Product Images

Without prejudice to your statutory warranty rights, we would like to draw your attention to the following:

Due to individual screen settings (e.g. resolution and brightness), slight differences may occur between the colours displayed on your screen and the actual product colours. If you are unsure, please contact us before placing your order.

5. Delivery Terms

5.1 Shipping Costs

In addition to the stated product prices, a shipping fee of EUR 5.00 applies for standard delivery.

5.2 Delivery Options

Products are shipped to the delivery address specified during the ordering process.

You may also collect your order in person at:

Collection is available during our business hours:
Monday to Thursday, 8:00 a.m. – 5:00 p.m., excluding public holidays.

Please notify us at least two working days before collection so that we can prepare your order. Payment by EC/debit card with PIN is also possible upon collection.

6. Payment

6.1 Prices

The prices displayed at the time of ordering shall apply. All prices are total prices and include the applicable statutory Value Added Tax (VAT).

6.2 Payment Methods

The following payment methods are generally available in our online shop.

Bank Transfer (Advance Payment)
If you choose payment by bank transfer, we will send you our bank details in a separate email. Your order will be dispatched once payment has been received.

Credit Card
You enter your credit card details during the ordering process. Your card will be charged immediately after your order has been placed.

Apple Pay
To pay via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the Safari browser, be registered with Apple, have Apple Pay activated, authenticate yourself using your Apple credentials, and confirm the payment instruction. The payment transaction is processed immediately after the order has been placed. Further information is provided during the checkout process.

PayPal / PayPal Express
To pay via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must have a PayPal account, log in using your PayPal credentials and confirm the payment instruction. The payment transaction is processed immediately after the order has been placed. Further information is available during checkout.

PayPal may offer additional payment options to selected customers at its own discretion. We have no influence over the availability of such options. Any additional payment methods offered are solely subject to the contractual relationship between you and PayPal. Further details can be found in your PayPal account.

7. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal as described in our Cancellation Policy. No voluntary right of withdrawal is granted to businesses.

8. Retention of Title

The products shall remain our property until full payment has been received.

For businesses, the following additionally applies: We retain title to the products until all claims arising from an ongoing business relationship have been settled in full. You may resell the goods subject to retention of title in the ordinary course of business. You hereby assign to us in advance all claims arising from such resale, irrespective of whether the goods are combined or mixed with other items, up to the amount of the invoice value, and we accept this assignment. You remain authorised to collect these claims. However, we reserve the right to collect the claims ourselves if you fail to meet your payment obligations. We will release any securities to which we are entitled at your request to the extent that their realisable value exceeds the secured claims by more than 10%.

9. Transport Damage

For consumers: If goods are delivered with obvious transport damage, please report such damage to the carrier immediately and contact us without delay. Failure to do so shall have no effect on your statutory rights, in particular your warranty rights. However, it helps us to assert our own claims against the carrier or the transport insurance.

For businesses: The risk of accidental loss or accidental deterioration of the goods passes to you as soon as we have delivered the goods to the freight forwarder, carrier or any other person or institution designated to carry out the shipment.

10. Warranty and Guarantees

10.1 Statutory Warranty Rights

Unless expressly agreed otherwise below, the statutory warranty provisions shall apply.

The following limitations and reductions of limitation periods shall not apply to claims arising from damage caused by us, our legal representatives or our vicarious agents:

  • in the event of injury to life, body or health;
  • in cases of intentional misconduct or gross negligence;
  • in the event of a breach of essential contractual obligations, the fulfilment of which is necessary for the proper performance of the contract and on which the contractual partner may regularly rely (cardinal obligations);
  • where a guarantee has been expressly given; or
  • where liability arises under the German Product Liability Act.

Limitations for Businesses

With regard to businesses, only our own product specifications and the manufacturer's product descriptions incorporated into the contract shall be deemed agreed characteristics of the goods. We assume no liability for public statements made by the manufacturer or other advertising claims.

For businesses, the limitation period for warranty claims relating to newly manufactured goods is one year from the transfer of risk. This limitation does not apply to goods that have been used for a building in accordance with their customary purpose and have caused the defect in the building.

The statutory limitation periods for recourse claims pursuant to Section 445a of the German Civil Code (BGB) remain unaffected.

Notice for Merchants

Merchants are subject to the inspection and notification obligations under Section 377 of the German Commercial Code (HGB). Failure to notify defects as required shall result in the goods being deemed approved unless the defect was not detectable during inspection. This shall not apply where we have fraudulently concealed a defect.

10.2 Guarantees and Customer Service

Information regarding any additional guarantees that may apply and their exact terms can be found with the respective product and on dedicated information pages within our online shop.

11. Liability

We shall be liable without limitation for claims arising from damage caused by us, our legal representatives or our vicarious agents:

  • in the event of injury to life, body or health;
  • in cases of intentional misconduct or gross negligence;
  • where a guarantee has been expressly assumed; or
  • where liability arises under the German Product Liability Act.

In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), our liability shall be limited to the foreseeable damage typical for this type of contract at the time the contract was concluded.

Any further claims for damages are excluded.

12. Dispute Resolution

We are willing to participate in an out-of-court dispute resolution procedure before a recognised consumer arbitration board.

13. Final Provisions

If you are a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us shall be our registered place of business.
